The Importance of Estate Planning
If you don’t plan your estate, the State of California will!
Your Estate Plan consists of the documents you have in place (or don’t have) that control your finances and health care decisions upon incapacity or death. Your estate plan is the result of what you do and what you don’t do. These actions or inactions affect your health and welfare and your loved ones’ ability to care for you without court interference or cost. Your actions or inactions also greatly affect your loved ones’ inheritance upon your death.
If you plan ahead and properly use a living trust, you can save your loved ones a lot of hassle and money. Choosing not to plan means that you have chosen the default plan provided by California law – intestacy.
The major reasons for planning are:
- To keep you out of Conservatorship Court;
- To keep your loved ones out of the Probate Court;
- To maximize the legal tax savings;
- To maximize control; and
- To protect your children by naming a guardian
